Fortunately, that is already beginning to happen. Almonds are delicious and nutritious. They are also lucrative. But almonds are thirsty. A calculation by a pair of Dutch researchers six years ago suggested that growing a single one of them consumes around a gallon of water.

This is merely an American gallon of 3. And water has to be paid for. His farm is wired up like a lab rat. Or, to be more accurate, it is wirelessed up. Moisture sensors planted throughout the nut groves keep track of what is going on in the soil.

With their introduction, local planning authorities were able to set aside their resistance to new home developments in the countryside and grant planning permission, where there is a genuine business need. The key condition of an AOC is that the owners of the new property are either agricultural employees and their dependantsor their widow or widower. AOCs were introduced to address the variety of rural commercial operations requiring an employee to be available on-site 24 hours a day, which was only possible if the employee had live-in accommodation.

Although an AOC allows for rural homes to be developed, it reduces the value that they sell for on the open market.

Unsurprisingly, most prospective buyers are unable to comply with agricultural ties as they are not wholly or mainly employed in agriculture, and so the pool of available buyers is correspondingly small. Fortunately it is possible to alter, suspend or discharge an AOC. The options are as follows, but it is not easy:. You must prove that you have not engaged in any agricultural work or recently retired from a job in agriculture.

In this instance, the AOC is not discharged but it is suspended until someone later moves in and complies with the conditions of the AOC, effectively re-setting the 10 year period. Where a property is at least 4 years old and not built in accordance with the original planning permission, there is potential to receive a CLEUD.

This is on the basis that the property is technically not consented to and so the occupancy condition cannot be correctly applied. To do this you need to lodge an application with evidence demonstrating that the condition no longer serves a useful purpose. You will need to market the property for a period of at least 12 months at a price that accurately reflects the lower market value taking into consideration the AOC. If you have not garnered interest in that period from prospective purchasers then you will have a strong case to present to the local council, who may then remove the AOC entirely.

Neither me or my husband are in agriculture. My husband use to work on a farm many years ago in Scotland. Now I am a teacher and he is in management. The bungalow use to have several fields attached to it but these were sold off many years ago.

So the bungalow stands by itself now with 2 acres of land. So this property cannot be used for agriculture and a main source of income can never be gained from this land. Firstly, how can I get around the ag tie so that my husband and I canm actually live in the property and secondly, why on earth does the property even have the agricultural tie seeing as thought nothing can be done with the land now as it's a lake - does this mean it will be easier for us to lift it if we managed to move into it.

The current owner is very old and has been in a home for a few years - the property is being sold to cover his nursing home fees. If anyone has any advice I'd greatly appreciate it - even if that advice is 'stay well away from any Agricultural restriction property' Thanks.

Agricultural ties, unless your primary occupation is farming, can be a nightmare. It is very difficult to get the tie lifted and, if you are not primarily employed in agriculture, you may be prosecuted by the local authority if you take up residence. If after that time, there has not been any demand for the property with the AOC conditions in place from qualifying parties, then you might be able to prove to the local Council that the AOCs should be lifted entirely.
